The Nebraska Department of Environmental Quality will finalize the New Source Review Reform changes to Title 129-Air Quality Rules and Regulations on Dec. 8, 2004. The draft Title 129 will be placed on public notice and will be available for formal public comment until it is presented to the Environmental Quality Council on Jan. 21, 2005. Testimony on the proposed changes will also be accepted at the Environmental Quality Council hearing.

These proposed changes to air quality regulations could affect businesses and industries that currently have Prevention of Significant Deterioration (PSD) permits or sources that are subject to the PSD program at the time they wish to go through some type of modification.

The new federal rules for the New Source Review program can be found in the Code of Federal Regulations at 40 CFR 51.166 or 40 CFR 52.21. NDEQ has written its own proposed version of the rules, which will be contained in an entirely new Chapter 19 of Title 129. Other chapters that will be affected by the proposed changes are 1, 2, 8, and 17.
