MoreAUSTIN, Texas — The Texas legislature is reviewing a proposed bill (S.B. 129) to regulate mold remediation and other mold-related activities, providing civil, administrative, and criminal penalties. Any mold-related activity performed by a third party for compensation; or Any mold-related activity performed in a facility owned or leased by a county or a city.
Titled the “Mold Remediation Licensing Act,” the businesses affected include:
The act defines a mold remediation company and the procedures for mold remediation. The act also defines mold as “any fungi or related products or parts, including spores, hyphae, and mycotoxins.”
The act takes effect on June 1, 2003 if it receives a two-thirds vote of House members. If it does not receive the required votes, it takes effect on September 1, 2003.
